Cap-gap extension for F-1 OPT students (2026 rules)

The cap-gap extension automatically keeps an F-1 student’s status, and any OPT or STEM OPT work permission, alive while a cap-subject H-1B change-of-status petition is pending or approved. Since the H-1B modernization rule took effect on 17 January 2025, the extension runs until 1 April of the fiscal year the H-1B is requested for, instead of the old 1 October end date. You don’t file anything yourself: SEVIS adds it, and your DSO can give you an updated I-20 showing it.

Why the cap-gap exists

H-1B selection happens in March and petitions are filed from 1 April, but the earliest H-1B start date is 1 October, the start of the US fiscal year. Many F-1 students finish their OPT in that window. Without help, their status would end months before the H-1B begins. The cap-gap fills that “gap” so you can stay, and keep working if you were on OPT.

USCIS processing does not always finish by 1 October. Under the old rule, if the petition was still pending on 1 October, the extension ended and the student had to stop working. The December 2024 final rule moved the end date to 1 April of the fiscal year, giving USCIS six more months to decide while you stay protected.

Who qualifies for the cap-gap extension

According to Study in the States, you qualify if all of these are true:

  • You are in a valid period of F-1 status. To keep working, you must also be in a valid period of post-completion OPT or STEM OPT.
  • You have not violated the terms of your status.
  • You are the beneficiary of a timely filed, cap-subject H-1B petition.
  • The petition asks for a change of status to H-1B (not consular processing abroad).
  • It requests an employment start date in the fiscal year for which H-1B status is sought.

Students in their 60-day grace period after OPT can also be covered if the petition is filed before the grace period ends. The extension then lets you (and any F-2 dependants) stay, but not work, because your OPT had already ended.

When cap-gap does not apply

  • Not selected in the lottery. A registration alone does nothing. A selection notice by itself does not give cap-gap either; a petition must be filed.
  • Consular processing. If the employer asks USCIS to notify a US embassy (for example in Kathmandu) instead of changing your status inside the US, there is no cap-gap.
  • Cap-exempt employers. Universities, nonprofit research organisations and government research organisations file cap-exempt petitions, which are not covered.
  • Status already lost, for example by exceeding allowed unemployment on OPT.

How to get an updated I-20 showing cap-gap

Employers, HR teams and the DMV often want to see proof that you are still allowed to work. That proof is your I-20 with the cap-gap comment, together with the I-797 receipt notice for the H-1B petition.

  1. Get the I-797 receipt from your employer or its attorney after USCIS accepts the petition.
  2. Wait for SEVIS to update. Normally SEVIS adds the extension automatically when USCIS logs the petition. A cap-gap indicator, a change-of-status comment and a page-2 comment on the I-20 appear.
  3. Ask your DSO for a new I-20. Most schools have a cap-gap request form. Send the I-797 receipt with it.
  4. If SEVIS has not updated, your DSO can ask the SEVP Response Center for a data fix. SEVP says to wait two weeks after USCIS confirms timely receipt before asking.
  5. Keep copies of the I-20, I-797 and your EAD together for your employer’s records.

If the petition is denied, rejected or withdrawn

The cap-gap ends immediately. You are no longer allowed to work in F-1 status, and you have a 60-day grace period to prepare to leave, change status or move to a new program. If you still have time left on OPT or STEM OPT, the original dates continue to apply. Speak to your DSO the same day you hear the news. If your employer withdraws the petition because you resign, the same rule applies, so think carefully before changing jobs during cap-gap.

What Nepali students should know

  • Plan your Dashain or Tihar trip carefully. Travelling outside the US while a change-of-status petition is pending can complicate the case. Speak to your DSO and the employer’s attorney before you book. Our guide to visiting Nepal on F-1 covers travel rules.
  • Your F-2 family members stay with you during the cap-gap, but they still cannot work. See our F-2 dependent visa guide.
  • STEM OPT and cap-gap together. If your STEM OPT has time left beyond 1 April, those original dates still protect you.
  • Taxes. Wages during cap-gap are still taxable. If you have been in the US five calendar years or fewer as a student, see our guide to US tax filing and Form 8843.

Common mistakes

  • Assuming a lottery selection notice alone extends your status. It doesn’t.
  • Not checking whether the petition was filed as change of status rather than consular processing.
  • Relying on the old 1 October end date that many older university pages still quote. The rule now says 1 April.
  • Stopping work too early, or working after the extension has ended.
  • Not keeping your US address up to date with your DSO and USCIS while the petition is pending.

What to do next

  1. Once you are selected, ask your employer to confirm the petition will request a change of status.
  2. Ask for a copy of the I-797 receipt as soon as it arrives.
  3. Request your cap-gap I-20 from your DSO.
  4. Put the 1 April date, and your original OPT end date, in your calendar.
  5. Read our H-1B lottery explainer and STEM OPT extension guide to plan ahead.

Frequently asked questions

How long does the cap-gap extension last?
Until 1 April of the fiscal year for which H-1B status was requested, unless the petition is approved earlier and H-1B starts, or it is denied, rejected, withdrawn or revoked.

Do I need to apply for cap-gap?
No. SEVIS adds it automatically after USCIS logs the petition. You only ask your DSO for an updated I-20 as proof.

Can I work during cap-gap?
Yes, if you were on valid post-completion OPT or STEM OPT when the petition was filed. If you were in your grace period, you can stay but not work.

Does cap-gap apply if my employer is a university?
No. Cap-exempt employers do not trigger the cap-gap extension.

What happens if my H-1B is denied during cap-gap?
The extension ends, you must stop working, and you have 60 days to prepare to leave or take another legal step.
